3. Client Authorization
By submitting a device, storage media, or data recovery request, you represent and warrant that:
- You are the legal owner of the device and data, or
- You have obtained proper authorization from the legal owner to request our services.
- The submitted media does not violate any applicable laws or regulations.
The Company reserves the right to request proof of ownership or authorization before commencing work.
4. Evaluation and Quotation
All devices may undergo an initial evaluation to determine the nature of the failure and the likelihood of recovery.
Following evaluation, a quotation will be provided outlining the recommended recovery process and associated fees.
No recovery work will proceed until approval is received from the client.
5. Fees and Payment
- Fees are based on device type, complexity, urgency, and recovery requirements.
- Payment terms will be specified in the quotation or invoice.
- All invoices must be paid within the agreed payment period.
- Recovered data may be withheld until payment obligations have been fulfilled.
6. No Guarantee of Recovery
Data recovery is a highly specialized process and results may vary.
The Company does not guarantee:
- Successful recovery of all data.
- Recovery of specific files or folders.
- Preservation of original file structures.
- Recovery within a specified timeframe.
Recovery estimates are provided in good faith but are not guarantees.
7. Data Confidentiality
We understand the sensitive nature of business information.
All client data is handled with strict confidentiality and accessed only by authorized personnel involved in the recovery process.
Upon request, Non-Disclosure Agreements (NDAs) may be executed prior to commencing work.
8. Client Responsibilities
Clients are responsible for:
- Providing accurate information regarding the device and issue.
- Maintaining independent backups whenever possible.
- Verifying recovered data upon delivery.
- Ensuring that recovered data is transferred to secure storage promptly.
9. Limitation of Liability
To the fullest extent permitted by law, Intelligent Computer Services shall not be liable for:
- Loss of data, revenue, profits, business opportunities, or goodwill.
- Consequential, indirect, incidental, or special damages.
- Damage resulting from pre-existing device conditions.
- Failure to recover all or part of the requested data.
The Company’s total liability shall not exceed the amount paid by the client for the specific service provided.
10. Storage and Collection of Devices
Recovered data and client devices will be retained for a reasonable period after project completion.
Devices or recovered data not collected within the designated retention period may be securely erased, recycled, or disposed of without further liability.
11. Digital Forensic Services
Forensic services are provided solely for lawful business purposes.
Clients are responsible for ensuring they possess the legal authority to request forensic examinations and access any submitted data.
The Company reserves the right to refuse any request that may violate applicable laws or regulations.
12. Intellectual Property
All reports, diagnostic findings, methodologies, and service documentation prepared by the Company remain the intellectual property of Intelligent Computer Services unless otherwise agreed in writing.
13. Website Usage
Users agree not to:
- Use the website for unlawful purposes.
- Attempt unauthorized access to systems or data.
- Disrupt website operations or security.
We reserve the right to suspend or restrict access where misuse is detected.
